Solarsuit Pty Ltd t/a        Cove Landing Marina Apartments Kangaroo Island (Cove Landing)

​OPERATIVE PROVISIONS     

SECTION (01) - LICENCE TO OCCUPY     

The Owner is the registered owner of the Accommodation.

Cove Landing is authorised by the owner of the Accommodation to allow the Guest to occupy and use the Accommodation on the terms of this Licence. The terms of the booking are between the guest and Cove Landing.

 

The guest is authorised to occupy the Accommodation during the agreed period as set out in the Booking Summary. The guest is not a tenant of the Accommodation and has not been granted exclusive possession of the Accommodation.     

This contract for Accommodation shall not be effective until Cove Landing sends the Guest written confirmation of the booking. The Guest acknowledges that Cove Landing acts as a booking agent for the Owner only and not as a principal.

SECTION (02) BOOKINGS, TERMS AND EXCLUSIONS

Items not permitted to be taken on or stored in any location on the Cove Landing Marina Apartments premises either internal of external are:

Lithium Ion batteries used in the following products are not permitted anywhere on site such as:

  • Electric Vehicles;

    • are not permitted to be stored in any location site

    • are not permitted to be charged from the Cove Landing Marina Apartments electrical supply​

  • e-Scooters or Electric Scooters:

    • ​are not permitted to be stored in any location on site

    • are not permitted to be charged from the Cove Landing Marina Apartments electrical supply​

  • e-Bikes or Electric Bikes or Pedal Assist:

    • are not permitted to be stored in any location on site

    • are not permitted to be charged from the Cove Landing Marina Apartments electrical supply​

  • e-Scateboards:

    • are not permitted to be stored in any location on site

    • ​are not permitted to be charged from the Cove Landing Marina Apartments electrical supply​

 

SMOKING:

  • Smoking of any substance in any manner is not permitted anywhere on the Cove Landing Marina Apartments property both internal or external. For example:

    • Smoking of Cigarettes is not permitted anywhere on the Cove Landing Marina Apartments property both internal or external.

    • Smoking of Cigars is not permitted anywhere on the Cove Landing Marina Apartments property both internal or external.

    • Smoking of Pipes is not permitted anywhere on the Cove Landing Marina Apartments property both internal or external.

    • Smoking of E-cigarettes or vaping products are not permitted anywhere on the Cove Landing Marina Apartments property both internal or external.​

COOKING RESTRICTIONS:

1.     Prohibition of cooking appliances: Guests are strictly prohibited from bringing or using any cooking appliances anywhere throughout the premises that are not supplied by the host. This includes, but is not limited to, portable stoves, hot plates, grills, air fryers, barbeques, slow cookers, woks and any other cooking device. This policy is in place to ensure the safety and comfort of all guests, so we thank you in anticipation of your understanding and cooperation.

 

NON-USE OF SPRAY TAN OR TANNING LOTIONS AND CREAMS (tanning products)

By booking and occupying any of the Cove Landing Marina Apartment Suites, you agree to adhere to the following terms and conditions regarding the use of spray tan:

 

  1. Prohibition of Spray Tan Usage: The use of spray tan, tanning lotions or cream products (tanning products) is strictly prohibited within the premises of Cove Landing Marina Apartments. This includes but is not limited to spray tan booths, aerosol cans, or any other similar products intended for application of artificial tanning.

  2. Reasons for Prohibition: The prohibition of spray tan usage is enforced to prevent damage to property, staining of surfaces, and to maintain cleanliness and hygiene standards within the accommodation.

  3. Liability: Guests are responsible for any damages caused by the use of spray tan products within the accommodation. This includes, but is not limited to, stains on furniture, linens, walls, or any other property within the accommodation.

  4. Cleaning Charges: In the event that spray tan products are used within the accommodation, guests will be charged for any additional cleaning required to restore the property to its original condition.

  5. Notification: Guests are required to notify the management immediately in the event of accidental spillage or use of spray tan products within the accommodation.

  6. Right to Evict: Management reserves the right to evict guests found in violation of this policy without refund.

  7. Acknowledgement: By booking and occupying the accommodation, guests acknowledge that they have read, understood, and agreed to abide by these terms and conditions regarding the non-use of spray tan products.

 

BOOKING, PAYMENT TERMS AND CANCELLATIONS 

Rates:

All rates are quoted in Australian dollars and are inclusive of the Goods and Services Tax and valid for the period specified. Pricing on third party sites is subject to their terms and conditions.

 

Bookings & Payment:

For all bookings, your credit card will be charged in full amount at the time of booking confirmation. Elements of your charges will be:

  • 100% of the accommodation tariff

  • $200 Security Bond (Refer Bond Conditions)

  • Cleaning fee.

  • Service fee.

  • Third Party Booking Agent Fee (where applicable)

Cancellations and Alterations:

All cancellations must be received in writing.

  • Cancellation up to and including thirty (30) days prior to arrival will result in loss of 100% loss of the booking tariff & fees unless your booking requirement can be secured by another guest for the same period.

  • Cancellation thirty-one (31) days or greater from the arrival date will incur no cancellation fee.

  • A $50.00 Administration fee will be charged for all alterations to bookings or cancellations.

Booking Terms

No booking is confirmed until Cove Landing has received your Registration information, these Terms accepted and the required payment for the booking is received. We accept payments by credit card only. 

Please note that any credit card fee/s taken is/are non-refundable, otherwise charged incorrectly.   

To secure the Booking, 100% of the full room tariff, Service Fee, Cleaning Fee and Security Bond is required to be paid at the time of the booking placement. Cove Landing does not ‘hold’ properties until this payment is confirmed as received.

Confirmation of Booking

Once the payment has been received, you will receive an email confirming your Booking.  The contract between us will only be formed when you receive the payment confirmation email and is subject to these Terms.     

You should carefully check the details of your Booking before making a payment, as well as the confirmation email and inform us immediately of any errors or omissions.   

All transactions are processed in Australian Dollars. 

All fees and charges will be inclusive of GST.    

If you have booked through an Agent website, the payment requirements of this site will apply to your booking.

 

Agent Cancellations and Amendments    

The Owner reserves the right to cancel a booking at any given stage issuing a full refund to the Guest. Cove Landing will endeavour to try and find suitable alternative accommodation for the Guest.

If this does happen, we will contact you as soon as possible.  If we cancel your Booking, we will refund you any fees you have already paid. We will not be liable to refund you for any fees you may have paid to any third party in connection with your holiday (including, without limitation, fees for travel, entertainment, activities, or insurance).    

Cove Landing and the Owner reserves the right to terminate any booking and immediately remove any Guest from the Property for failure to comply with the Terms of their booking, in which case there would be no refund of any monies paid and an automatic charging of the Security Bond/Pre-Authorisation pursuant to section 7 below, on the Guest’s stipulated credit card. 

 

SECTION (3) ARRIVALS AND DEPARTURES & SECURITY BOND

Arrival or Check-in time is from 2:00pm, Departure or Check-out time is 10.00am

All indoor areas, including suites and public spaces, of Cove Landing Marina Apartments are strictly non-smoking. Smoking is permitted in outdoor areas of the Apartments or within the property boundaries. Pets may not be brought onto the premises with the exception of guide dogs. Guests shall comply with all rules, regulations, and instructions at Cove Landing, including but not limited to security procedures, health and safety procedures and registration requirements.

Cove Landing shall be entitled to refuse a guest entry or accommodation or to require a guest to leave the premises if unreasonable behaviour is displayed, be it threatening or abusive, causing disturbance to other guests or otherwise unacceptable. Cove Landing will not accept liability for loss or damage to guest property.

  • EARLEY CHECK IN: Any early check in request must be approved in writing prior to your arrival at the property.

  • OVERSTAY: Any costs incurred to Cove Landing due to unauthorised overstaying or later check out by any guest may result in an additional night being charged and will be deducted from the security deposit/pre-authorisation. Should the charges not be covered by the security bond, then we reserve the right to charge your nominated credit card.

  • ACCESS CODE: you will be provided your unique access code prior to your arrival that will give you access to the Southern entrance and to your nominated apartment only.

  • CHECK OUT: Please refer to check out instructions on the arrival details confirmation. Charges will apply for breach of this term.

  • CALL OUTS: Any call outs, outside of office hours will incur a $150 call out fee.

 

DAMAGE: 

Cove Landing Apartments and all things within are presented to you in pristine condition. Accidental damage is unfortunate and unwelcome, however, in the event of damage by you, we reserve the right to charge your nominated credit card.

AS a specific note; Turmeric is not permitted to be used at Cove Landing. Charges associated rectification will be at your expense in full.

SECTION (4) RELEASE, INDEMNITY AND PROPORTIONATE LIABILITY

To the extent permitted by the law, you agree to release, indemnify and hold harmless, Cove Landing and its current and former officers, employees, contractors, sub-contractors/consultants (including their respective employees and contractors) and the Owner, its agents and subcontractors (the Indemnified Parties) against, from and in respect of all expenses, costs, liabilities, claims, actions, proceedings, damages, judgments and losses of any kind whatsoever (including but not limited to consequential and economic losses, property loss/damage and damages for injury, including personal injury and death) arising out of, caused by, attributable to or resulting from your booking or your stay at the relevant Accommodation except to the extent such expense, cost, liability, claim, action, proceeding, damage, judgment or loss arose out of, was caused by, attributable to or resulted from the Indemnified Parties; negligence, wrongful act/omission or breach of these Terms.

To the extent permitted by law the aggregate of the Indemnified Parties’ liability to you is limited to an amount not exceeding the amount paid by you for your booking.

Each indemnity in these terms and conditions is a continuing and independent obligation and survives the termination or expiry of these terms and conditions.

 

SECTION (5) HEALTH & SAFETY

Security CCTV

To ensure the ongoing privacy and security of our guests, CCTV surveillance can be found in all public access areas including more specifically:

  1. The Carport Area

  2. The Southern Access Door (External).

  3. The Public Access Corridor (Southern End)

  4. The Public Access Corridor (Northern End)

  5. The Northern Access Door (External).

  6. The Undercroft 

 

Security Keyless Entry

To further ensure the ongoing safety and security of our guests, we have installed Keyless Entry to the Southern Access Door and each Suite respectively.

You will be supplied with your Personal Identification Number (P.I.N.) on the eve of your arrival. For your safety and security, keep this P.I.N. confidential and do not publish and share with any third party. Cove Landing Marina Apartments therefore accepts no responsibility for any loss or damage as a result of the misuse of you P.I.N.

 

General

If you become aware of anything during your stay which you believe is a health & safety risk you must inform Cove Landing immediately.

You must comply with the House Rules and you must also comply with any building regulations.     

These Terms solely apply to the registered names and number of guests on the booking confirmation. They do not apply to additional visitors or occupants.

The Booking Summary specifies the maximum permitted number of guests to stay in the Accommodation. If we are notified of any additional guests occupying the property, then additional charges may apply.

In addition to the house manual, the following House Rules apply to all properties:     

  • Keep the Accommodation clean, tidy and clear of rubbish.

  • Leave the Accommodation in the same condition as you find it.

  • Not keep or take any pets or animals into the Accommodation (unless otherwise agreed in writing

  • Any Accommodation including part of a building or complex with common property, do not leave any objects or waste in any common property. 

  • Any illegal or immoral activity from the Accommodation is not permitted.

  • e-Vehicles similar to those listed above but not restricted to them, are not permitted anywhere on the property.

  • Smoking Cigarettes or E-Cigarettes is not permitted anywhere on the Property.

  • Guest shall only park cars in areas specifically identified for Guest use by Cove Landing. There is provision for one (1) vehicle per apartment and any additional vehicles, boats and the like are to be parked outside the Property grounds.

  • Furniture is not to be moved at the Property and no item from the Property is to be removed from the Premises. Only outdoor furniture is to be used outdoors.

  • Guests are to ensure all bins are lined and rubbish to be placed in the bins provided. Guests will be charged $150.00 per excessive bag/box of rubbish not removed from the premises at checkout and fish is not to be cleaned on premises.

 

SECTION (6) CONSUMER LAW

To the extent permitted by law, all conditions, warranties, guarantees, rights, remedies, liabilities and other terms implied or conferred by statute, custom or the general law that impose any liability or obligation on Cove Landing are excluded under these Terms.

 

Nothing contained in these Terms and Conditions excludes, restricts or modifies the application of any provision, the exercise of any right or remedy, or the imposition of any liability under the Australian Consumer Law or under any international consumer protection legislation, provided that, to the extent that such law permits Cove Landing to limit its liability, then Cove Landing’s liability is limited to:

 

in the case of services, supplying the services again or payment of the cost of having the services supplied again; and

in the case of goods, replacing the goods, supplying equivalent goods or repairing the goods, or payment of the cost of replacing the goods, supplying equivalent goods or having the goods repaired. 

 

SECTION (7) USE OF THE PROPERTY

Unless written permission

any business or commercial activity is not permitted in the accommodation;     

not make any alteration or addition whatsoever to the Accommodation or its contents;     

not use the Accommodation for any purpose other than for personal accommodation;    

Parties and Gatherings 

Parties and Gatherings are strictly prohibited without prior written consent of the property owner. If you breach this condition, instant loss of bond, immediately evicted without notice and without refund or credit for any nights unused.  

Noise to be kept to a minimum after 8:00pm.

Legislated noise pollution controls shall prevail at the Property and Guests are obligated to comply with any Body Corporate rules and regulations (where applicable). No guests are to create or permit any noise or nuisance, which is likely to interfere with the peaceful enjoyment of any other person occupying adjoining Apartment.

Any complaints from any owner, neighbour, local authority (not limited to) reported to the agent including: nuisance, annoyance, inconvenience or disturbance of residents causing damage, playing loud music or musical instruments, dancing, entertaining at the Accommodation will be investigated. 

Should there be a serious breach of this clause 6 Terms, Guests will face immediate eviction without notice and without refund or credit for any nights unused.

 

SECTION (8) PRIVACY

In accordance with section 18N(1)(b) of the Privacy Act 1988 (Cth) the Guest authorises its credit providers to disclose credit information about the Guest to Cove Landing for the purposes of Cove Landing assessing the Guest’s credit worthiness, credit standing, credit history or credit capacity in relation to its Accommodation booking.

Guests are not to invade the privacy of the owner. Private contact information is not to be published or revealed in any way which might allow a third party (social media sites) to identify the address of the property or owners contact/personal information (even if such information is already in the public domain)    

You acknowledge that the Accommodation is a home and you agree not to access any cupboard or drawers which have been sealed with tamper tape or obviously closed / locked off.  

 

SECTION (9) SECURITY BONDS/PRE-AUTHORISATIONS

Up to a $500 refundable Security Bond / credit card Pre-Authorisation (Security Bond) is also required to be paid to cover any incidental breakages or other costs incurred as a result of your booking. 

Your Security Bond is due at the time of booking.

This Security Bond will be refunded to you within seven (7) days from departure of the property, pending a final inspection of the property once the guest has departed.  

 

SECTION (10) PROPERTY DAMAGE 

The Guest acknowledges that the Security Bond shall be deducted from the nominated credit card for any extra cleaning, breakages, loss, damages to the Property or its surrounds, breach of the terms and conditions or any additional fees incurred as stipulated in this agreement. 

You must notify Cove Landing of any damage to the Accommodation, contents fixtures or fittings which occurs during your stay, even if you regard the damage as fair wear and tear or if you do not believe the damage, is your fault.     

If you do not notify Cove Landing of any such damage you will be fully liable for such damage on a full replacement basis.   

Cove Landing reserves the right to charge in the event of any late check outs or overstaying by a Guest.

 

SECTION (11) GENERAL     

Cove Landing will be entitled to sub-contract or delegate their obligations under this Agreement.     

These terms and the Booking Summary represent the entire agreement between the parties and supersede any previous marketing information, representations or agreements whether recorded in writing or otherwise.  

The parties agree that these terms are fair and reasonable in all the circumstances. However, if any provision of these terms is held not to be valid by a Court of competent jurisdiction but would be valid if part of the wording were deleted, then such provision shall apply with such deletions as may be necessary to make it valid. If any of the provisions in these terms are held not to be valid the remaining provisions of these terms shall remain in full force and effect.     

Repairs and maintenance will be completed within business hours Monday-Friday. Unless it's deemed an emergency. 

We do our best to attend to all maintenance issues as and when we are notified during typical work hours. During the following days and times, we will not be able to confirm any type of callout, unless deemed an emergency.

Weekends (Fridays 4pm - Monday 10am)

Public Holidays and outside work hours (after 4:00 pm - before 9 am Monday-Friday ) 

We will not compensate any guests who request repairs/callouts during the above timeframes as it is very difficult to source tradespeople during the above-mentioned hours.

 

SECTION (12) LISTING AND PROMOTIONAL INFORMATION

Cove Landing has used its best endeavours to maintain the accuracy, currency and correctness of all advertising materials and information given to them with respect to the Property. Nothing in those materials shall be treated as a term or condition of this contract and details are subject to change without notice.

Cove Landing invites Guests to inspect the Property prior to the booking dates, at a time suitable to the Manager, as the Manager is not liable for and will not issue a refund to any Guest who is not satisfied with or does not consider the Property booked to be suitable as a result of any difference of opinion as to the condition or quality of the premises, the surrounds, nor for any temporary defects or stoppages of any utilities. 

Properties may not appear exactly as pictured or described due to normal Property wear and tear, a change in furnishings or any other changes that may have occurred after the advertising materials were published.

Cove Landing will not accept any responsibility for any matter or occurrences beyond the Manager’s reasonable control including (but not limited to) damage caused by extreme weather conditions, breakdown of appliances, wiring, plumbing, invasion of pests or noise disturbance.

 

SECTION (13) DESCRIPTION OF THE ACCOMMODATION

All information in respect of the Accommodation contained on the Cove Landing or any Agent’s website is believed to be correct at the time of the publication, however, all details are subject to change by Cove Landing and/the Owner without notice. 

Cove Landing will not accept any responsibility for any alterations to the Accommodation or any part thereof beyond Cove Landing control or any liability for any matter or occurrences beyond Cove Landing’s reasonable control including damage caused by extreme weather conditions, breakdown of appliances, wiring, plumbing, invasion of pests, or any act or omission on the part of the Owner causing loss, accident or injury to the Guest or any one or more of them.

 

SECTION (14) COMPLAINTS 

The Guest must immediately (within 24 hours) notify Cove Landing of any complaint or problem with the Property, should there be one, and allow the Manger a reasonable amount of time to remedy the problem or find the Guest suitable alternate accommodation if the problem cannot be resolved within a reasonable amount of time.  The Manager must use discretion in deciding the severity and outcome of the complaint or problem. Failure to notify Cove Landing will void any claim following the booking period and vacating the Property does not constitute an adequate cause for the Guest to be refunded.

 

SECTION (15) LIABILITY

No liability is accepted for any injury, debt, damage, loss, delay, expense or inconvenience caused directly or indirectly to any Guest or their personal belongings, baggage, vehicle and other Property whilst staying at the Property. Neither the Owner nor Cove Landing accepts any responsibility for any events beyond the Manager or Owner’s control.

The Guest acknowledges that the use of any of the Properties facilities (swimming pool, outdoor spa, tennis court or the like) which may result in injury, loss or damage to the Guest or their Property is the Guest’s responsibility and the Manager and Owner will not accept any liability arising there of.

It is recommended that Guests take out personal property insurance or adequate travel insurance should any unexpected situations arise before or during your travel period.

 

Failure to comply with any of the above conditions may result in immediate termination of your License to Occupy.

Cove Landing reserve the right to change the wording, add to, delete or modify these Terms from time to time.

 

SECTION (16) PROPERTY DISCLAIMER

Whilst every effort is made by the staff and management of Cove Landing Marina Apartments to ensure the safety of its guests, guests acknowledge as a condition of making their bookings that neither Cove Landing Marina Apartments nor any of its staff shall be liable for the death or injury of any of its guests or for any direct, indirect or consequential loss or damage whatsoever (save where caused by the negligence or wilful misconduct of Cove Landing Marina Apartments) suffered by any of its guests arising out of or in connection with use of the facilities and activities offered by Cove Landing Marina Apartments, in particular (but not limited to) these involving wildlife, and the guest, by making a booking, releases Cove Landing Marina Apartments and its staff from all or any such liability.

 

SECTION (17) LOST PROPERTY

If items belonging to guests are found by Cove Landing Marina Apartments staff and the owner can be clearly identified, the guest will be contacted, and the item will be returned to them by registered mail at the owner cost. If the owner of a found item cannot be identified, the item will be logged and held in security for three months. If the owner does not contact the property or is otherwise not identified within this period, the item will be disposed of. If the item is deemed to have tangible benefit, it will be donated to a local charity organization after the three-month period.

 

SECTION (18) FORCE MAJEURE

Cove Landing Marina Apartments shall not be liable for any failure or delay in performing its obligations under these Terms and Conditions if such failure or delay is due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, civil unrest, strikes, lockouts, labour disputes, pandemics, governmental actions, or interruptions in telecommunications or power supply. In such events, Cove Landing Marina Apartments' obligations shall be suspended for the duration of the event, provided that it takes all reasonable steps to mitigate the effects of the force majeure event. All bookings are subject to availability, and Cove Landing Marina Apartments shall be entitled to refuse any booking on reasonable grounds.

 

SECTION (19) WEBSITE USE

By accessing the Cove Landing Marina Apartments website, you agree to use it solely for lawful purposes and in a manner that does not infringe upon the rights of, or restrict or inhibit, anyone else's use and enjoyment of the website. Prohibited behaviour includes harassing or causing distress or inconvenience to any person, transmitting obscene or offensive content, or disrupting the normal flow of dialogue on the website. You must not use the website to send unsolicited commercial communications. Additionally, you are prohibited from using the website to post or transmit any material that is unlawful, threatening, defamatory, obscene, or otherwise objectionable, or that infringes upon any party's intellectual property rights..

 

SECTION (20) License

You are granted permission to temporarily download one copy of the materials (information or software) on the Cove Landing Marina Apartments website for personal, non-commercial, and transitory viewing only. This is a license grant, not a transfer of ownership, and under this license you may not:

  • Modify or copy the materials;

  • Use the materials for any commercial purpose or for any public display (whether commercial or non-commercial);

  • Attempt to decompile or reverse engineer any software on the Cove Landing Marina Apartments website;

  • Remove any copyright or other proprietary notations from the materials;

  • Transfer the materials to another person or 'mirror' the materials on any other server.

This license will automatically terminate if you violate any of these restrictions and may be terminated by Cove Landing Marina Apartments at any time. Upon termination of this license or when you cease viewing these materials, you must destroy any downloaded materials in your possession, whether in electronic or printed format.

 

SECTION (21) LINKS

Cove Landing Marina Apartments has not reviewed all the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Cove Landing Marina Apartments of the site. Use of any such linked website is at the user’s own risk. 

 

SECTION (22) INTERNET PROTOCOL (IP) ADDRESS

When you visit our site, we automatically collect your Internet Protocol (IP) address to help administer our website, and analyse trends to improve the site's performance and user experience. Your IP address is also used to gather broad demographic information and for monitoring and preventing fraudulent activity. We may share this information with our service providers and partners, but only for the purposes outlined in this policy. Your IP address is treated as confidential and is protected in accordance with our Privacy Policy. By using our site, you consent to the collection and use of your IP address as described herein.

 

SECTION (23) PERSONAL DATA AND PRIVACY

Data protection is very important to Cove Landing Marina Apartments and the Personal Information (any information relating to you) of our customers is treated absolutely, positively confidential. When we need to collect information from you, we generally ask you to voluntarily supply us with the required data. This data will not be made accessible to third parties except if required by law, by court or by a regulatory authority.

Furthermore, your Personal Information will only be processed for the purposes indicated at the time of collected as indicated in the Privacy Policy https://www.covelandingki.au/privacy-policy / or as evident under the circumstances. Please do note that your acceptance of our Privacy Policy is a condition of these Legal Terms and Conditions.

 

SECTION (24) SITE TERMS OF USE MODIFICATIONS

Cove Landing Marina Apartments reserve the right, at our sole discretion, to modify or replace these Terms and Conditions at any time. Any such modifications shall be effective immediately upon posting the revised terms on this site. It is your responsibility to review these and Conditions periodically to stay informed of any changes. 

 

SECTION (25) DISCLAIMER

The materials on the Cove Landing Marina Apartments website are provided ‘as is’. By authorisation of these Terms by selecting the checkbox, the Guest acknowledges and agrees that should it or any additional occupants or visitors breach any of the terms and conditions stated herein, you will pay to Cove Landing the total loss or damage that it suffers as a result of that breach. Further, you hereby authorise Cove Landing to debit your credit card or apply your refundable deposit in payment of that loss or damage and Cove Landing may evict you and your guests without notice.
